Article 1 of Federal Decree-Law No. 38 of 2021 regarding Copyrights and Neighboring Rights defines a work as any innovative production in the fields of literature, arts, or sciences, regardless of its type, method of expression, importance, or purpose. The author is the person who creates the work, or whose name is associated with it.
What Intellectual Works Are Protected by Law?
The intellectual works protected by law include:
- Books, brochures, articles, and other written works.
- Smart applications and computer software and their applications.
- Lectures, speeches, sermons, both oral and written.
- Dramatic works and dramatic-musical compositions.
- Audiovisual works, including both auditory and visual works.
- Architectural works and engineering drawings and designs.
- Drawings in lines or colors, photographic works, and similar.
- Works of applied and visual arts, illustrative works, geographical maps, planning diagrams, and derivative works without prejudice to the protection granted to the original works from which they are derived.
Protection also covers the title of the work if it is innovative, and the written innovative concept for a broadcast program.
Duration of Protection for Intellectual Works
According to Article 20 of the Copyright and Neighboring Rights Law, the financial rights of the author are protected for the duration of their life plus fifty years starting from the first Gregorian year following their death. However, for authors of applied art works, the financial rights expire twenty-five years from the first Gregorian year following the first publication.
The UAE Ministry of Economy is responsible for registering intellectual works in the country.
